(b) By submitting any material to us ('Material') you acknowledge that we may copy, modify, distribute or create a derivative work from the Material in any manner that we shall determine. You will indemnify us if any third party takes action against us in relation to the Material.

(c) We reserve the right to charge you to access certain information on the Site. We will inform you where a charge will be incurred by you for accessing certain services or information.

(d) You must not cause any nuisance, annoyance or inconvenience to us, our customers or our users of the Site.

All orders that you place on the Website will be subject to acceptance in accordance with the following terms of use ("Terms") for the katetemple.co.uk website ("Site"). You can print off these terms, or store them in your computer, for future reference. Please read them carefully.

1. CONDITIONS OF SALE

In order to create a contract between you and us, please follow the simple on screen instructions taking you through the process of placing an order on the website. To place an order for the products select "Go to Checkout", "Confirm Order details" page, "Confirm my Order". In doing this you offer to buy the Goods at the prices indicated as well as any applicable delivery charges. We will send an automated order acknowledgement email to you, listing the products you have ordered. Please note that this email is merely an acknowledgement of your order and not an acceptance or confirmation of your order by Toast.

The acceptance of your order and the completion of the contract between you and us will take place on dispatch of the products unless we have notified you that we have not accept your order or you have cancelled it. Once we have accepted your order it becomes binding, subject to your rights of cancellation. Non-acceptance of an order by us will occur in circumstances including we identify a pricing or product description error; the ordered product is out of stock or unavailable; or if we are unable to obtain authorisation for your payment.

2. PRICING AND AVAILABILITY

We reserve the right to withdraw any products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

3. CUSTOMS

If your order is to be delivered outside the European Union, it may attract import duty and local sales taxes which customers will need to pay on receipt of the shipment. Any additional charges for customs clearance must be borne by you. These rules vary by country and your local government determines duty and customs charges, so you should contact your local customs office for further information.

4. CANCELLATIONS

You have the right to cancel your order at any time before you receive the products you ordered, by contacting by email studio@katetemple.co.uk.

If these Products have already been assigned or dispatched when you contact us, you may return them within 14 calendar days of receipt of delivery to receive a full refund. Your initial postage and packing charges will be refunded, unless you opted for Express delivery, in which case only the standard postage and packing charges will be refunded.

You will be responsible for the cost of returning your items to us, unless your order total was £125 or above; see section 5 below.

5. RETURNS AND EXCHANGES

Please note that section 4 above only applies where you are cancelling your entire order with us.

You may return your purchase for an exchange or refund within 14 calendar days of receiving it. Simply post the item(s) back to us at the address listed on this page.

If you return your order in full to us within 14 calendar days of receiving it, we will also refund your initial postage and packing charges, unless you opted for Express delivery, in which case only the standard postage and packing charges will be refunded. Your statutory rights on cancellation are not affected.

We are not responsible for return postage for orders, for return or exchange from outside the UK or for sale items, so please attach the correct postage. Incorrect, mis-described or faulty items can be returned free of charge by contacting customer service. Sadly, we cannot be responsible for parcels that fail to reach us, so please make sure you obtain a certificate of posting as proof of posting.

Exchanges will be honoured any time within 14 days of receipt of your purchase.

We ask that you return the items unused, with all the original tags intact and complete the returns form supplied with your delivery. Exchanges are subject to availability.

To ensure a more efficient returns process, please can you attach the return address label that is located on the bottom left-hand corner of the despatch note you received with your order to the parcel when you return it. This will enable us to scan the bar code on that label and send email confirmation to you that your parcel has been safely received.

We aim to process all returns within 48 hours of reaching us and will email or write to confirm when this has been done. Sometimes the limitations of the banking system mean that the refund may take a further few days to show up on your card statement.

4. INTELLECTUAL PROPERTY RIGHTS

(a) The Site and its content are protected by intellectual property rights, including copyright and trade marks, as detailed in our Intellectual Property Notice. Toast reserves its rights in respect of this.

(b) Except as expressly authorised by us or relevant third parties, you agree not to copy, download, adapt, alter, modify, rent, lease, loan, sell, distribute or create derivative works of any content of the Site, in whole or in part.

5. DISCLAIMERS

(a) Your use of the Site is at your sole risk. The Site is provided on an "as is" and "as available" basis and we do not guarantee that the Site will be suitable for your purposes or requirements. If your PC does not support relevant technology including encryption, you may not be able to use certain services or access certain information on the Site.

(b) The Site is accessed via the World Wide Web which is independent of us. Your use of the World Wide Web is solely at your own risk and subject to all applicable national and international laws and regulations. We shall have no responsibility for all information or service obtained by you on the World Wide Web.

(c) The content of the Site has been compiled from a variety of sources and is subject to change without notice.

(d) We reserve the right to vary the terms from time to time, such variations becoming effective immediately upon posting to the Site and by continuing to use it, you will be deemed to accept any such variations.
